Fēnxiǎng - Terms of Service

Welcome to Fēnxiǎng ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") outline the terms and conditions governing your use of our platform and services. By accessing or using the Platform, you agree to comply with and be bound by these Terms. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and any additional terms and conditions applicable to specific services.

2. User Accounts

2.1 Registration: To access certain features of the Platform, you are required to create an account. You must provide accurate, current, and complete information during the registration process and promptly update such information to keep it accurate and complete.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3. Rental Services

3.1 Rental Listings: Our Platform allows users to rent and lend fashion items. Users can create listings for available items, and renters can request to rent those items.

3.2 Rental Agreements: Users agree that each rental transaction is a separate agreement between the item's owner (lender) and the renter. The Platform is not a party to these agreements but serves as a facilitator.

3.3 Rental Payments: Renters agree to pay the rental fee, as well as any applicable fees, as specified in the rental listing. Payments are processed through Faster Payment Service (FPS).

3.4 Returns and Damages: Renters agree to return items in the same condition as received. Any damages or discrepancies should be reported promptly. Lenders agree to inspect returned items and report any issues within a specified timeframe.

4. Content Guidelines

4.1 User Content: You retain ownership of any content you submit to the Platform, such as listings, reviews, and comments. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content on the Platform.

4.2 Prohibited Content: You agree not to post, upload, or share any content that is illegal, offensive, infringing, deceptive, or harmful. We reserve the right to remove any such content and terminate accounts.

5. Intellectual Property

5.1 Platform Content: The Platform and its content, including but not limited to text, graphics, logos, images, and software, are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License: We grant you a limited, non-exclusive, revocable license to access and use the Platform for personal, non-commercial purposes.

6. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our discretion, including for violation of these Terms or for any other reason.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law principles.

9. Changes to Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms.
